Puppy Purchase Agreement

This Puppy Purchase Agreement (the "Agreement") is made and entered into by and between Amanda Schnell (the "Breeder") and the Buyer (the "Purchaser"). By signing this Agreement, the Buyer agrees to the following terms and conditions regarding the purchase of a puppy from the Breeder.

1. Health Guarantee

The Breeder guarantees that every reasonable precaution has been taken to ensure the puppy is in good health and well-socialized at the time of sale. The Buyer is required to have the puppy examined by a licensed veterinarian within four (4) business days of receipt.

• If the veterinarian determines that the puppy has a significant health issue, the Buyer must provide a written assessment from the examining veterinarian detailing the condition.

• The Buyer must return the puppy to the Breeder within four (4) business days of receipt, along with the veterinarian’s written assessment. Failure to return the puppy within this time frame will result in the Buyer assuming full responsibility for its health and well-being, and no returns or exchanges will be permitted thereafter.

• If a return is made within the specified timeframe and a valid health concern is documented, the puppy will be replaced with a puppy of equal value, subject to availability. No refunds will be issued under any circumstances.

• If the puppy were to pass away within four (4) days of receipt, the Buyer must provide a veterinary statement confirming the cause of death. If the death was due to an unavoidable illness and not preventable through veterinary care, a replacement puppy of equal value will be provided at the Breeder’s discretion. The Buyer will be responsible for all associated shipping costs.

• No guarantees are made regarding the puppy’s temperament, adult size, conformation, color, or breeding potential.

• The Breeder is not responsible for any veterinary expenses incurred by the Buyer after the purchase.

2. Vaccinations & Health Records

The puppy will be up to date on all age-appropriate vaccinations and deworming treatments at the time of sale. The Buyer will receive a copy of the puppy’s health records.

3. Puppy Loss While in Breeder’s Care

If the puppy passes away while still under the Breeder’s care, the Buyer will receive a replacement puppy of equal value at the earliest availability. No refunds will be issued.

4. Estimated Adult Size

Any estimated adult weight provided by the Breeder is based on the best available information but is not guaranteed.

5. Hypoglycemia & Dehydration

The Breeder does not provide a guarantee against hypoglycemia (low blood sugar) or dehydration as these are common conditions in young puppies. The Buyer assumes full responsibility for monitoring and managing these conditions with proper care and veterinary guidance.

6. Coccidia Disclaimer

Coccidia, a common puppy issue that can arise due to stress, is not covered under this Agreement. It is the Buyer’s responsibility to treat and manage this condition with veterinary assistance if necessary.

7. Deposit Policy & Refunds

• All deposits are non-refundable.

• No refunds will be issued under any circumstances once the puppy has been received by the Buyer.

8. Nutritional Requirements

Before taking the puppy home, the Buyer must purchase Nutri-Cal (available in the vitamin section of PetSmart or other pet supply stores).

• The Buyer agrees to administer Nutri-Cal every 8 hours, day and night, to support the puppy’s health and prevent hypoglycemia. Recommended until 6 months of age.

9. Governing Law & Jurisdiction

In the event of any legal disputes arising from this Agreement, both parties agree that the laws of the State of Texas shall apply. Any disputes shall be resolved in the state courts of Austin, TX, or, in the case of diversity of citizenship, the United States District Court for the appropriate district. Both parties expressly waive the right to a trial by jury.

10. Miscellaneous Terms

• This Agreement constitutes the entire understanding between the Breeder and the Buyer and supersedes all prior agreements, whether oral or written.

• No modifications to this Agreement shall be valid unless made in writing and signed by both parties.

• If any provision of this Agreement is found to be unenforceable, the remaining provisions shall remain in full force and effect and shall be interpreted to best reflect the original intent of the parties.

By signing below, both parties acknowledge that they have read, understood, and agreed to the terms and conditions outlined in this Agreement.
