Health Guarantee

Amanda Schnell agrees to sell the puppy to the Buyer under the following terms:

1. Every precaution has been taken to see that your new puppy is personable and in good health and I want you to be completely satisfied with your selection. To this end, you should have your puppy examined by your veterinarian immediately. In the event your vet is not satisfied with the puppy’s condition, a written assessment from said vet stating in what respect the puppy is unsound must accompany the puppy and it must be sent back to me. I will not assume any responsibility for this puppy if return is not made within four business days of receipt of the puppy. If the puppy is not returned within four business days of receipt of puppy, all responsibility of the puppy is to the purchaser and no returns or exchanges will be made under any circumstances. If a return is made within four business days the puppy will then be replaced at the earliest availability with a puppy of equal value, there will be no refunds under any circumstances. Your puppy will be guaranteed for four days from the day you receive it. If your puppy were to not live, it will be replaced with a puppy of equal value as soon as one is available. You will be able to choose the puppy yourself. I will need a statement from your vet as to the cause of death. It will be at my discretion as to whether a replacement will be made. If the puppy died of an illness, and the death could not have been prevented by veterinary care a replacement will be made. No guarantee is made as to the disposition, size, conformation, color, or breeding capability. I will not be liable for any expense or vet bills incurred by the purchaser. Buyer will be required to pay all shipping costs for the replacement puppy. There will be no refunds under any circumstances.

2. The puppy has had all age appropriate immunizations and de-wormings. Buyer will receive a copy of the records for both of these.

3. If the puppy dies while still in my care the puppy will be replaced at the earliest availability with a puppy of equal value and quality, no refund will be given.

4. Any estimated grown weight listed with a pup is only our best guess and not a guaranteed number.

5. I do not guarantee against hypoglycemia or dehydration, they are both the responsibility of the new puppy owner.

6. Coccidia is a common puppy problem and can be brought on by stress, I do not guarantee against this. It is easily treated by the new puppy owner and their veterinarian.

8. No refunds will be given under any circumstances

9. All deposits are non-refundable

10. YOU MUST HAVE NUTRICAL FOR YOUR PUPPY BEFORE YOU TAKE IT HOME!
This can be bought in the vitamin section of Petsmart. You must feed this to your puppy every 8 hours day and night.

GOVERNING LAW: In the event of litigation both parties agree that the Law of TX shall apply and both parties consent to the jurisdiction of the state courts of Austin, Tx, or in the event of diversity of citizenship, the United States District Court for the (District). Both parties expressly waive a trial by jury.

MISCELLANEOUS: The Terms and Conditions constitute the entire agreement between you and Amanda Schnell. The Terms and Conditions supercede all prior or contemporaneous communications and proposals, whether electronic, oral or written between you and Amanda Schnell. No modification of the Terms and Conditions shall be effective unless it is authorized by Amanda Schnell. If any provision of the Terms and Conditions is found to be contrary to law, then such provision(s) shall be constructed in a manner to closely reflect, as much as possible, the intentions of the parties, with the other provisions remaining in full force and effect.
